This category is for those individuals investing in the United Kingdom by setting up or taking over (and being actively involved in the running of) one or more businesses in the United Kingdom. Entrepreneurs will need to have access to £200,000 that must be disposable in the UK and held in a regulated financial institution. Applicants will also need to meet the English Language and Maintenance requirements.

Further information about the category

Initial permission to enter or remain in the United Kingdom will be for a three year period. Those making their application outside the United Kingdom must obtain an entry clearance in their home country or country of lawful residence before travelling. Certain individuals are eligible to "switch" whilst in the United Kingdom and we can provide advice in this respect. It should be noted that employment can't be entered into other than working for the business or businesses that have been established, joined or taken over.

Extensions: To qualify successfully for an extension under this category, applicants will need to demonstrate that the £200,000 was invested in a UK business and that they had registered with HM Revenue and Customs as a self employed person or director of a new or existing business within three months of their initial grant of leave to enter or remain.

The individual must also need to demonstrate that they are engaged in running the business and have created two full time jobs for persons settled in the United Kingdom, which have lasted for at least 12 months.

Individuals are also required to meet the English Language and Maintenance requirements.

Indefinite leave to remain: Individuals who have spent five continuous years in the United Kingdom in this category may be able to apply for indefinite leave to remain, subject to meeting all the relevant criteria at the time of application. Individuals may aggregate previous leave as a Business Person and/or as an Innovator.

Accompanying family members: Family members will almost always require entry clearances before travelling to the United Kingdom and these will usually be applied for at the same time as the main applicant. They can also be included in applications for extensions or indefinite leave to remain.
