Labour Agreements and Invest Australia Supported Skills agreements are formal agreements between an employer and the Australian Government which allow skilled workers into Australia. The Australian Government encourages overseas skilled workers to meet the skills shortage - these options provide flexible and streamlined options where there are larger numbers of workers, or large foreign investment is being made in Australia.

The positions in these formal agreements are based on employer or industry need and do not necessarily appear on occupation lists. For temporary entry, the formal agreement replaces the need to seek sponsorship. The position nomination and visa application processes are the same as for the Temporary Business (‘457’) visa (click here for details). Labour Agreements

Labour agreements are formal agreements between an employer and the Australian government which allow a number of skilled workers to enter Australia to satisfy a specific skills shortage on a temporary or permanent basis.

Situations where labour agreements may be used include:

  1. Where there is a need for a particular skill, and there is a shortage of this skill, and the relevant occupation does not appear on any of the approved occupation lists
  2. Where an industry association or group requires a significant number of skilled workers
  3. Where a significant number of skilled workers are needed for a short term project
  4. Recruitment companies who supply skilled workers to businesses

Employers or industry associations provide information to the Department of Immigration and Citizenship and the Department of Education, Employment and Workplace Relations in relation to:

  1. The need for the skilled workers;
  2. The company operations;
  3. Evidence of attempting to recruit within Australia; and
  4. Evidence of an employer training program for Australian citizens and permanent residents

After the agreement is negotiated and signed by all parties, the processes are similar for both the temporary and permanent entry employer sponsored visas.

Invest Australia Supported Skills (IASS) Agreements

This also a formal agreement between an employer with a head office outside Australia and the Australian government for significant investment to be made in Australia. These agreements differ from Labour Agreements in that they involve the transfer of managerial and or specialised staff to establish business in Australia, and in terms of processing is afforded a higher priority.

The application process is effectively the same as that for Labour Agreements above, apart from the initial agreement, which is considered for approval by the Department of Tourism, Industry and Resources, in consultation with the Department of Education, Employment and Workplace Relations, and the Department of Immigration and Citizenship.
